Florida Legislature passes International Commercial Arbitration Bill

HB 821 was passed unanimously by the Florida legislature and enrolled today. This bill replaces the Florida International Arbitration Act with the Florida International Commercial Arbitration Act and is effective July 1, 2010.

Arbitration: Solution or Problem for International Companies?

I recently read an interesting article in the ABA Journal related to if arbitration is really a solution or a problem for international companies. The concern that has been discussed a lot is how the United States litigation model is shifting into international arbitration. Cost and speed have often been two pros of choosing arbitration over other alternative dispute resolution methods. As many reference, companies are choosing litigation over arbitration. This isn't to say arbitration is gone however. It is still a very popular method, but comes with several concerns in the international arena. Question for thought: Americanizing international arbitration, yes or no?
